TO THE FULLEST EXTENT PERMISSIBLE BY LAW, MSMSURVEY DISCLAIMS ALL WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE (A) UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR (B) THAT THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MSMRESEARCH AND INSIGHTS INC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE.
• ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

You agree that any legal action or proceeding arising out of or related to these Terms or the Service shall be brought exclusively in the state or federal courts located in Delaware, and you hereby consent to the exclusive jurisdiction of such courts.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. Any changes will become effective immediately upon being posted on the website. We will notify you of any changes by posting the new Terms on this site. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

12. Termination
